Hamilton County Unified Development Ordinance Adopted

An Ordinance Adopting The New Hamilton County Unified Development Ordinance and Repealing The Prior Zoning Ordinance and Subdivision Control Ordinance

Date of Approval:  On July 25, 2022, the Hamilton County, Indiana, Board of Commissioners approved Ordinance #07-25-2022-A, which adopted the new Hamilton County Unified Development Ordinance.  

Subject Matter:  This ordinance amends all Articles and sub-ordinances in the Hamilton County Zoning Ordinance Number 3-19-90 and Subdivision Control Ordinance Number 4-16-90 B.  

It creates a Unified Development Ordinance by amending ALL articles of the Zoning Ordinance and Subdivision Control Ordinance and combining them into one document.  

As a result of this amendment, all previous versions of the Ordinances are void.  

Amendments include restructuring and adding articles and updating regulations and permitted uses.

Geographic Area To Which Ordinance Applies: the entire jurisdiction of the Hamilton County Plan Commission including all zoning classifications. 

The Plan Commission’s jurisdiction applies to all real property located in unincorporated areas in Adams, Noblesville, Wayne, and White River Townships that do not fall under the jurisdiction of another plan commission.

Penalty Provision:  This ordinance contains a penalty provision that permits the imposition of fines and penalties and also authorizes the county to initiate enforcement action, including seeking injunctive relief.  This provision is Article 26 and entitled “Enforcement.”  It is found on pages 195-196 of the ordinance.

Public Inspection of the Ordinance:  In addition to being available online at https://www.hamiltoncounty.in.gov/818/Plan-Commission, the ordinance may be examined at the office of the Hamilton County Plan Commission, One Hamilton County Square, Suite 306, Noblesville, Indiana.
